Terms of Use
1. Eligibility and purpose
The App is intended for users aged 13 and over and is not directed to children. It is an offline sound player and multi-track mixer for general relaxation and background listening. It is not a medical device, sleep tracker, diagnosis, treatment, therapy, emergency service, or substitute for professional advice. Do not use it where loss of audio could cause harm.
2. License
Subject to these Terms and applicable Google Play terms, Ocean Barque grants a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on compatible Android devices you control. You may use packaged sounds and covers through normal playback and mixing. You may not copy, extract, sell, rent, sublicense, publicly redistribute, repackage, reverse engineer, or create a competing library from the App or its media, except where applicable law or an explicit license permits it.
3. Content and third-party licenses
The App includes sound recordings, cover images, fonts, icons, and software components. Some audio and images are used under commercial licenses obtained from third-party marketplaces. Those licenses may limit redistribution, extraction, resale, or use outside the App. Installing the App does not transfer ownership of third-party content.
4. Custom mixes and local data
You may create local mixes from packaged sounds, IDs, and volume settings. You are responsible for custom-mix names and must not use them to harass, threaten, impersonate, infringe rights, or introduce malicious instructions. Custom mixes and compatible favorites remain local; there is no account-based cloud sync or backup. Clearing App data or uninstalling removes them.
5. Advertising and privacy choices
A release may show a content-area banner, an App Open ad, or an interstitial at a permitted natural interruption point. Ads will not be placed in lock-screen controls, notification controls, or the audio service. Google UMP may show consent and privacy choices. Do not interfere with consent dialogs, ad measurement, fraud prevention, or advertising SDK operation. The Privacy Policy is part of these Terms for privacy matters.
6. Purchases and Premium
The App is free to download. A release may offer a Premium subscription that unlocks VIP content and removes ads, plus a separate one-time remove-ads product that removes ads only and does not automatically unlock Premium. Google Play shows product details, price, currency, period, renewal, trial, offer, taxes, availability, and required disclosures before purchase. This draft sets none of those parameters. Google Play processes the transaction and provides purchase-management and refund controls.
A pending, cancelled, refunded, revoked, or failed transaction may not grant or continue the relevant entitlement. Do not bypass purchase checks or use altered purchase records. Do not email payment-card details, purchase tokens, or passwords to support.
7. Availability and interruptions
Playback may be interrupted by calls, Bluetooth or wired-headphone changes, another exclusive audio source, Android power management, device settings, unsupported files, or hardware limits. Background playback, notifications, lock-screen controls, and timers depend on compatible Android versions and device behavior. Ocean Barque may update, suspend, restrict, or discontinue features, content, SDK integrations, or versions when reasonably necessary for security, law, platform requirements, licensing, reliability, or maintenance.
8. Acceptable use and intellectual property
You must not use the App unlawfully, violate third-party rights or licenses, interfere with playback, consent, advertising, purchases, security, or updates, extract assets, introduce malware, or misrepresent Ocean Barque’s relationship with Google or any content provider. The App’s software, design, content selection, branding, and documentation are owned by or licensed to Ocean Barque. Except for the limited license in these Terms, no rights are granted.
9. Disclaimer and liability
To the maximum extent permitted by applicable law, the App is provided on an “as available” and “as is” basis. Ocean Barque does not promise sleep, health, medical, emotional, or performance outcomes. We do not exclude non-waivable consumer rights. To the maximum extent permitted by law, Ocean Barque will not be liable for indirect, incidental, special, consequential, exemplary, or loss-of-data damages arising from use or inability to use the App.
10. Suspension, changes, and applicable law
You may stop using and uninstall the App. Ocean Barque may suspend or terminate access to address misuse, security, legal, platform, licensing, or material breach issues. We may update these Terms when the App, commercial features, licenses, laws, or service practices change; the published version will show its effective date. These Terms do not remove mandatory rights under the law that applies to you. This draft does not designate a governing law or dispute venue because those details have not been supplied for publication.
